Subject: Proposal for Modification of Birth Certificate Form-5 to Include Mother's Pre-Marriage Name, Address and Marriage Registration Number

Respected Sir/Madam,

I respectfully submit this proposal for consideration in the larger public interest, particularly for the protection of women's identity, legal rights, and ease of record management in future generations.

At present, the Birth Certificate Form-5 records the names of the father and mother. However, after marriage, many women change their surnames and addresses. As a result, future verification of family lineage, inheritance records, property claims, succession matters, caste verification, educational records, genealogical studies, and various legal proceedings often become difficult due to the absence of pre-marriage details of the mother.

Proposal

I request that the following additional fields be incorporated in Birth Certificate Form-5 and in the Birth Certificate issued thereafter:

1. Mother's Full Name Before Marriage (Maiden Name).
2. Permanent Address of Mother Before Marriage.
3. Blank Space/Field for Marriage Registration Number and Date of Marriage Registration.
4. Provision for digital linkage of birth records with registered marriage records wherever available.

Expected Benefits

1. Preservation of Women's Original Identity

The maiden name and original address of a woman will remain permanently available in an official public record, preventing loss of identity after marriage.

2. Simplification of Succession and Inheritance Matters

Future generations will find it easier to establish family relationships and legal heirship during succession, inheritance, and property transfer proceedings.

3. Better Protection of Women's Property Rights

Daughters and their descendants will be able to establish maternal lineage more easily when claiming rights in ancestral and self-acquired properties.

4. Support for Genealogical and Family Record Verification

Authentic family trees can be established with greater accuracy, reducing disputes relating to parentage and lineage.

5. Assistance in Caste, Tribe and Community Verification

Authorities will be able to verify maternal records more effectively whenever required under applicable laws and regulations.

6. Support for Government Welfare Schemes

Accurate identification of women and maternal family records will help in efficient implementation and verification of social welfare schemes.

7. Reduction in Fraud and Identity Disputes

Permanent recording of pre-marriage information and marriage registration details will reduce impersonation, identity disputes, and fraudulent claims.

8. Better Integration of Civil Registration Systems

Linking birth registration and marriage registration through a common reference number will strengthen India's civil registration system and improve data accuracy.

9. Assistance in Missing Person and Legal Investigations

Authorities will be able to trace family connections more effectively where maternal records are essential.

10. Empowerment of Women

This reform will recognize and preserve a woman's independent identity before marriage and uphold her dignity in official records.

Conclusion

In view of the above, I humbly request the Office of the Registrar General of India to examine the feasibility of amending Birth Certificate Form-5 and related rules to include:

• Mother's full name before marriage,
• Mother's pre-marriage address,
• Marriage Registration Number and Date,
• Digital linkage between birth and marriage registration records.

This small administrative reform can significantly strengthen women's rights, family record transparency, and legal certainty for future generations.

महोदय/महोदया,

महिलांची स्वतंत्र ओळख, त्यांच्या कायदेशीर हक्कांचे संरक्षण तसेच भविष्यातील अभिलेख व्यवस्थापन अधिक सुसंगत होण्यासाठी हा प्रस्ताव आपणांस सादर करीत आहे.

सध्या जन्म प्रमाणपत्रातील फॉर्म क्र. ५ मध्ये आई-वडिलांची नावे नोंदविली जातात. तथापि, विवाहानंतर अनेक महिलांचे आडनाव व पत्ता बदलतो. परिणामी वारसा, उत्तराधिकार, मालमत्ता हक्क, वंशावळ पडताळणी, जात प्रमाणपत्र, शैक्षणिक नोंदी व विविध न्यायालयीन प्रकरणांमध्ये आईची विवाहपूर्व ओळख सिद्ध करणे कठीण होते.

प्रस्ताव

जन्म प्रमाणपत्र फॉर्म क्र. ५ मध्ये पुढील बाबींचा समावेश करण्यात यावा:

१. आईचे विवाहपूर्व पूर्ण नाव (Maiden Name).
२. आईचा विवाहपूर्व कायमस्वरूपी पत्ता.
३. विवाह नोंदणी क्रमांक व दिनांक भरण्यासाठी स्वतंत्र जागा.
४. जन्म नोंदणी व विवाह नोंदणी यांची डिजिटल जोडणी करण्याची तरतूद.

अपेक्षित लाभ

१. महिलांची मूळ ओळख कायम राहील

विवाहापूर्वीची अधिकृत ओळख कायमस्वरूपी जतन होईल.

२. वारसा व उत्तराधिकार प्रकरणे सुलभ होतील

भविष्यातील पिढ्यांना नातेसंबंध सिद्ध करणे सोपे जाईल.

३. महिलांच्या मालमत्ता हक्कांचे संरक्षण

मुलींना व त्यांच्या वारसांना मातृक बाजूची ओळख सिद्ध करणे सुलभ होईल.

४. वंशावळ पडताळणी सुलभ होईल

कौटुंबिक नोंदी अधिक अचूक व विश्वासार्ह बनतील.

५. जात, जमात व इतर पडताळणीत मदत

आवश्यकतेनुसार मातृक कागदपत्रांची पडताळणी अधिक प्रभावीपणे करता येईल.

६. शासकीय योजनांच्या अंमलबजावणीस मदत

महिलांची अचूक ओळख उपलब्ध असल्याने लाभार्थी पडताळणी सुलभ होईल.

७. फसवणूक व ओळखविषयक वाद कमी होतील

विवाहपूर्व माहिती व विवाह नोंदणी क्रमांकामुळे खोटी दावे व बनावट ओळखी रोखण्यास मदत होईल.

८. नागरी नोंदणी व्यवस्थेची मजबुती

जन्म व विवाह नोंदणी यांच्यातील दुवा अधिक सक्षम बनेल.

९. तपास व शोध कार्यास मदत

हरवलेल्या व्यक्ती किंवा कायदेशीर तपासांमध्ये मातृक ओळखीचे महत्त्वपूर्ण योगदान मिळेल.

१०. महिला सक्षमीकरण

विवाहपूर्व स्वतंत्र ओळखीचा शासकीय अभिलेखामध्ये सन्मानपूर्वक समावेश होईल.

निष्कर्ष

वरील बाबींचा विचार करून जन्म प्रमाणपत्र फॉर्म क्र. ५ मध्ये खालील बाबींचा समावेश करण्याबाबत आवश्यक दुरुस्ती करण्याची कृपा करावी:

• आईचे विवाहपूर्व पूर्ण नाव,
• आईचा विवाहपूर्व पत्ता,
• विवाह नोंदणी क्रमांक व दिनांक,
• जन्म व विवाह नोंदींची डिजिटल जोडणी.

ही सुधारणा महिलांचे हक्क मजबूत करण्यासाठी, कौटुंबिक पारदर्शकता वाढविण्यासाठी आणि भविष्यातील पिढ्यांसाठी विश्वासार्ह अभिलेख प्रणाली निर्माण करण्यासाठी अत्यंत उपयुक्त ठरेल.
